Do I always need consent to divide my land? Yes, unless the two parts are already separated by a public road or railway. Any transfer, mortgage, or 21-plus-year lease of a portion of a property needs consent under the Planning Act.
How many lots can I create with a severance? Consent is best suited to creating a small number of lots. Where several lots, new roads, or significant servicing are involved, the municipality will typically direct you to a plan of subdivision instead.
What happens if my severance is refused? A refusal — or conditions you disagree with — can be appealed to the Ontario Land Tribunal within 20 days of the decision. We can prepare and carry that appeal.
How long is a provisional consent valid? Conditions of provisional consent must be fulfilled within two years, or the approval lapses and you have to start over.
Will I also need a minor variance? Often, yes. When the proposed lots don’t fully meet zoning standards for frontage, area, or setbacks, a minor variance is run alongside the consent. We handle both together.
